First let me start out by saying that I am not a lawyer, and am just going on things that I have heard through experiences. My best advice is to consult an immigration lawyer that specializes in business startup to get the EXACT particulars.
However, from what I know... H Visa's allow for you to startup a business. The issue is when it comes to managing it or taking a payroll from it. From what I have heard, H Visa's do not allow for you to manage or take payroll from a business. Usually, management is hired to conduct the operations of the business. The business owners, have ownership in the company and receive money through maybe a dividend or stock share. Again, I am not 100% positive on this. This is something you definitely want to consult an immigration lawyer for because you don't want to jump into something you may have issues with.

I am on the same boat with you. I had a Advanced Parole with Employment Authorization for 1 year and it just expired couple days ago. Now they have issued me another H4 visa . I would like to open a business and I have heard that forming a S corporation is fine without getting a paycheck and using the profits for your business expenses.
