I am told by an attorney that a wife can not be held responsible for her husbands debts. Is this true and where can I verify/find it in the Florida statutes.

This forum does not dispense legal advice. You can contact the Florida Bar aasociation for an attorney referral. Or you can go to the nearest law library and look up the information. You may also be able to find something on the internet apart from WestLaw.

Florida law: Spouse has no liability

What you are saying is that you DO NOT believe what the attorney told you.

Right.

I think you have gotten the best answers to your question. Your local Bar Association should be able to help you with this or another attorney. If you paid for the advice, the attorney should be willing to show it to you.

Luckiest, I guess if you get second opinions for doctors, then it is cool to get it for lawyers. But like you, I am curious why they doubt the first attorney?

You admitted you asked the question in the wrong way and then proceeded to be most disagreeable. Diversion instead of help? I referred you to the library AND WestLaw AND the internet.

I am not a lawyer. I got this information from a lawyer at a seminar. This is true for Florida, only

Not only that, but also marrital assets can't be claimed as an individuals assets for a judgement. Plus, in anticipation of a law suit of a judgement, assets can be converted into marital assets and becoem safe from claim. Also, retirement assets are not subject to claim, nor are assets in a non-revocable family trust.

It doesn't seem fair, does it ?

See a lawyer.
