There are many background checks in our industry. The most common background check begins with the verification of a persons social security number in combination with a criminal record search. The most common criminal record check begins at the county court house. Criminal records at the county courts are public record and most background screening companies will search for criminal records at the county courts where ever a person has lived for the last 7 years. Other commonly used tools to screen people are sex offender databases, drug testing and driving records. Many employers in today's economy don't have the man power to verify information found on resumes and applications so it is a growing trend to outsource the verification of employment and education. Lastly the federal government has required companies to verify if a person can work in the United States through the E-verify program. This is another tool to screen employees.

Is it legal to ask a potential employee to let you also run a background check on the rest of the household that they come from. Sometimes, with fraud, I worry more about someone working in partnership with a non-employee partner

You can ask for those written recommendations however I don't find that many employees have or keep on file written recommendations from previous employers.

You would have to have a signed release by all members of the household to conduct the background check but only if you outsource or purchase the background check from a third party. If you conduct your own investigation you do not need to have a signed release.

Is it possible to use these background checking services for "personal" purposes? Such as requests to do a background check on a potential son-in-laws or daughter in-law?

If you use a third party source to check out your potential son -in law or daughter -in law you could use a background screening service however under Federal law you would need to get a signed release by this potential son in law or daughter in law to prescreen them.

One of the most increasing trends in the industry is to re-screen employees on an annual basis for criminal records as well as sex offender information. Secondly many employers are now requiring many of the contractors that enter an employer office or work environment to go through the same standard background check that a "new hire" would go through with an employer.

The Fair Credit Reporting Act (FCRA)was enacted by Congress in 1970 to protect consumers. The Fair Credit Reporting Act was put in place to require consumer reporting agencies like background screening companies and credit bureaus to "adopt reasonable procedures" to protect consumer information. All background screening companies and credit bureaus produce reports that speak of the person's character, mode of living, etc. The FCRA allows for individuals to dispute information on their report with background screening companies and credit bureaus.
