Looking to hire trustworthy employees? Don't know how to find them?

I run a small family run convenience store and we hired part time help outside our immediate family this fall. We were lucky that it worked out. I would like to free up more of my time and hire another part time worker. This of course gets my wife very nervous. I think we are most concerned about accidently hiring someone who has a history with the law. Are there any free resources I can leverage? Any systems in the library, city, or on the web that ensures who I am hiring isn't a felon? What information would I need from the applicant for this check (that I can obtain legally via employment application)?

When you want to screen an employee do you have to tell them? Or have them sign a consent form? Or is it legal to do it without them knowing?

What are my rights as an employee? What can or can't an employer request? Or are they at liberty to request any type of information because I am applying to work for their company?

When you apply for a job, the employer must have you sign a release prior to the background investigation. Once the release is signed the employer is at liberty to request any information about you that they can search either via public records or contacting references. The Fair Credit Reporting Act also allows you as an applicant to know your rights under the federal law. The employer should provide to you the specific consumer right documents document that outlines your rights as a consumer. Several States also have specific consumer rights documents that you can get from your employer.

Howard,
Criminal records are public record and you can walk into most court houses in the United States and retrieve criminal information about an individual. Many courts are viewing this as a source of revenue and they are beginning to charge for this information. More courts are also offering free access to the public records but you must be forewarned that many of the searches are typically name and date of birth only which is truthfully not an accurate search because there are possibilities that a person can share the same name and same date of birth. Many courts have removed social security numbers due to identity theft so using free information is not always the most accurate or up to date. When your applicants complete the application you should have name, address, social security number and date of birth to accurately complete a search. Your release form should be separate from the application. Having a separate but conspicuous release form informs your applicant that you are serious!

Background checks are important because it can reduce poor hiring practices which can lead to loss in productivity, theft and workplace violence indicents. Workplace violence issues can lead to negative press which could lead into damage of a company's reputation and it could impact future company earnings. The latest information on negligent hiring lawsuits show the average lawsuit over two million dollars.

What do you think about "investigating" a prospective employee by searching Facebook or Myspace. Do you think that would be helpful or reliable? And would you recommend that?

Using Facebook and Myspace is a tool that many recruiters are using to determine a persons character but could be a first place to start however it will be highly unlikely that it was reveal criminal records and public record information.
