Can I lease a personal vehicle that i own to the company?

The vehicle is owned by me personally and would like to lease it to corp... The corporation would lease it for the amount of maintance, fuel and insurance. How do I make the agreement to read that way.

Who are you?? Are you an officer of the Corp?? Do you have an Accountant??

I have a vehicle that I purchased under my own name....not through corporation. It is insured through the corp. I was told by insurance company that i needed to lease it to my corp. I would like to lease it for the amount of "pay for maintenance", "fuel", "insurance" cost.

Yes. Just be sure that the rental charge is at fair market value and, otherwise, the same as an unrelated, third party would have leased the same vehicle to the corporation. That avoids your being attributed some compensation from the transaction. You'll still need to keep up with personal versus business use of it and file the IRS info form for that at year-end.

K. I am no accountant. However, the "fair market value" would have to be equal to the insurance, fuel and maintenance for the year. And if so, how do I look up the fair market value?

Side note: what if there is little business miles attributed to this vehicle. For example, if my wife is the vp of the company and doesn't do much "work" for the company.

It all depends on how aggressive you want to be.

The IRS publishes a annual statement of values for leased vehicles. Look it up on their site as "personal use of motor vehicle" or some such. Or, call a dealership and ask what they'd lease a 200X ABC for based on qualifying credit. Maybe take an average of the two. Save your documentation. Maintenance would just be added onto the monthly payment.

Legally and taxwise, no use for business would mean limited deduction as it's prorated. Again, how aggressive do you want to be?

I'd recommend getting a local tax person to advise you. When it's aggressive, it's better to get an opinion or at least good advice.

Yes you can in regards to the insurance portion it is important not only to have an agreement on file but to also list the party on the approriate policy.
If your auto policy is a business auto policy insuring your personal auto you best make sure you are listed as additional insured and loss payee no different than any lein holder!
Example : if you own the car and insure it through the co and ther is a loss and the proper docs are not done you may lose all claim.... why? There is no insurable intrest in that car under the plicy guidelines!

Also by leasing it to the co the company can pay the insurance paymnet maintain the car etc.. as line item costs..... if you use it personally the miles as compensation may come into a factor as far as compensation on that I would seek an accountant
