I am currently employed in IT industry as Sr. Software Engineer and willing to start something of my own. I have GC. I basically first want to get some H1B transfers of my friends and not going for new H1B application. Later on when market gets better I am planning plan to grow my business.

So in this case I would like to get some basic detail about this business and then once finalize I am planning to go to some legal consultancy.

Sorry for late reply as last week was somewhat hectic for me.

Regarding working together, pbusiness@gmail.com is my email id. We can talk more about that in detail and I too have one friend who wants to join me.

I would like to do as per law. I too don't want only H1B to my company. If I can give jobs to few more residents (citizens and greencard holder) then nothing greater than that. But I cant do all in starting so need to know what is minimum requirement in terms of nos of employee and other rules.

Do you have any website where I can get more details about all these?

I have few more questions if you can help me out.

1. How risky is it for now to open such company as the market is bad considering below things?

Can I transfer H1B of others to my company?
Will there be any problem for those who are transferring their H1B to my new company? Will there be any chance that their H1B transfer get rejected?

2. What about filing greencard for H1B employees. I know this is not a good time for that, but still want to know as things will be better in future.
How and when a new company will be eligible to file greencard for their H1B employees? Is it same as company need to have 2 yrs of healthy revenue proof and then only will become eligible to file greencard for their
employees.

I don't know how the transfer process works. So as I am thinking to get some of my friends' H1B to my company, I think there should not be any problem to them.

I am asking this as I don't know how new company is considered when H1 transfer happens.

Would you guide me to some CPA to get more info on this?

Do you have direct clients where you can place your employees on the client site?If you plan to hire H1B employees then USCIS most likely ask you to submit the client contract. You should also have good financial standing which includes atleast 2 years of your company's W2. Most of the cases that I have seen gets rejected due to ability to pay issues.
