1099 or comission/ payroll questions & workerscomp

I looking at going to payroll. I'm use to paynig employee 1099. I recently hired a few new people and in the hair industry we are use to the 1099. I not sure if I pay comission what the rules are? Can they still do 1099? If I do payroll and withhold taxes do I have to have workers comp?

In most cases whether employee/1099 contractors you may need workers compensation insurance.

From what I am familiar with, you need workers comp for all employee and for 1099, if they do not have their own worker comp certificate you need to provide it and deduct it from the check you pay to them.

Again check with your accountant in your particular instance.

The board is very strict about this workers comp issue.

You need to work with an accountant/an insurance agent on this issue to determine if you need one based on your industry and state laws.

The fact to determine 1099/employees is very strict and all your circumstances must be considered before deciding which way to go.
