Your H-1B work visa limits you to work only for the employer who sponsored your H-1B visa.  Any other active work, for any other employer, including for a company that you may open yourself in the U.S. is outside the scope of your permission to work and not permitted.  This also puts your H-1B status in jeopardy.&lt;br /&gt;
&lt;br /&gt;
You can have your own company in the US. But you cannot work actively for it.  For example, you can invest money in a US company and hire somebody else to do the work and you will getting the profit.  You can also own an Indian company.  Any work you do for it in the U.S., however, could be considered illegal.  Working in your spare time in the U.S. for an Indian company and getting paid in India may be very difficult to discover, nonetheless it does not make it any more legal.&lt;br /&gt;
&lt;br /&gt;
You should consult with an immigration attorney before you start working as this may threaten your H-1B status in the U.S.&lt;br /&gt;
